Yes. It is an upskirt photo, because he took a photo up their skirt without their consent, so it is sexual harassment.

Let's remember who the real criminal is and why there are mandatory shutter sounds on Japanese phones.

You cannot take a photo of someone without their consent, let alone a panty shot of a minor. Are you kidding me?

PSA: If you can see someone's underwear, treat it like when you see someone with their zipper open -- either ignore it or let them know with a gesture. Don't take a picture for crying out loud.

The law allows public photos of everyone. But you are not free to do whatever you like with it. If it is to be used in an advert it would require a model release. No consent is needed for public photos.

I would not be taking any photos of people travelling on trains.
