So, Trump trying to take power that isn't his to grab. Standard stuff. The courts will block this in less than 1 day.
Changing the birthright amendment requires lots of states and the senate to agree.
I actually like the goal of this. Only long term, legal, residents of the US should have their children become citizens automatically. Anyone illegally in the US or on a short term Visa shouldn't be able to create an anchor baby to be rewarded with Citizenship.
No more carrots for people illegally in the US. That policy has failed since before Reagan.
I hope the 14th amendment is modified. If it can be done (doubtful), it needs to happen THIS year or momentum will be gone and it won't have much chance again.

The US Supreme Court already dealt with this matter in 1898 in the case of Wong Kim Ark. They ruled that since Wong was born on US soil he was a US Citizen nothwithstanding his parents illegal entry into the US and the Chinese Exclusion Act.

Melonia became a US citizen 28 July 2006.
Barron was born 20 March 2006.
Baron was not born to an American mother.

Yup. And since most of SCOTUS are originalists, the history and tradition underlying the 14th Amendment and the 1898 case would make reversal of Wong Kim Ark difficult to justify.

That's not a counterargument at all.

So if you're born to a person who is subject to the laws of the United States (such as an undocumented immigrant) and you yourself are subject to the laws of the United States, you are a citizen of the United States.
