His third option would be to plead the fifth against self incrimination as he answered congress, under oath, while he faced a federal investigation into his criminal behavior. Even by the chaotic standards of trump's bizarre picks, that would have been impossible for him and would have forced even senate republicans to vote against the confirmation.
